Boston man pleads not guilty to open and gross lewdness charge after exposing genitals to victim sitting in car

Waltham District Court Judge Edward Karcasinas scheduled a pretrial hearing for Malachi Scott, 29, of 77 Ruthven St., Boston, at a status review hearing at Waltham District Court on Feb. 3.

Scott pleaded not guilty to open and gross lewdness at an arraignment on Jan. 28 following his arrest on Jan. 27.

Waltham police arrested Scott after receiving a report from a victim that a man had repeatedly exposed his genitals and engaged in lewd conduct from inside his vehicle near 32 Cushing St.

According to a police report, the victim was sitting in her car when she saw a man drive by looking down. Moments later, the victim saw the same vehicle slowly approaching again. The victim said the driver had his pants down and began engaging in lewd conduct as he drove past her. Then, the vehicle drove by a third time, though the victim said she didn’t observe the driver doing anything.

Officers matched license plates on a vehicle in the area registered to Scott that matched the description and plate number given by the victim.

Scott is scheduled to appear at Waltham District Court for a pretrial hearing on March 24.

Additional court actions

Judge Ellen M. Caulo scheduled a status review hearing of a mental health evaluation for Pierce Osgood, 29, homeless of Concord, N.H., at a hearing on Feb. 2. Osgood pleaded not guilty to receiving a stolen motor vehicle, unlicensed operation of a motor vehicle, negligent operation of a motor vehicle, a marked lanes violation and giving false identification information to law enforcement at an arraignment on Jan. 29. Caulo ordered Osgood committed to the Middlesex Correctional Institute in Framingham pending a competence to stand trial evaluation. Osgood is scheduled to appear at Waltham District Court on Feb. 20.

Caulo also disposed five firearm and drug related charges for Khansee Chalernsouk at a status review hearing on Feb. 4. The defendant pleaded not guilty to six charges at an arraignment on Sept. 5. Additionally, Caulo scheduled a March 2 non-binding bench trial for Chalernsouk’s remaining charge of malicious destruction of property less than $1,200.
