Court Report: Lavallee hearing scheduled

Michelle Clancy, 27, of 269 School St., Waltham, pleaded not guilty at her arraignment on Aug. 4 for assault with a dangerous weapon. According to a police report, Clancy was arrested following an incident near 738 Main St. Clancy was released from Waltham District Court on the condition that she stay away from the person pressing charges against her. She awaits a Lavallee protocol hearing on Sept. 18.

Lavallee protocol hearings have been implemented in the wake of the public defender work stoppage in Massachusetts that started on May 27. According to the protocol, if defendants who qualify for public defenders are not provided a lawyer within 45 days, their cases will be dismissed. 

Other court actions

Gerson Pineda-Jimenez, 34, of 95 Crescent St., Waltham, pleaded not guilty at his arraignment on Aug. 5 for driving while under the influence of alcohol and unlicensed operation of a motor vehicle. According to a police report, he was arrested on these charges in front of a Prospect Street residence that morning at 1 a.m. He was released on the condition that he appear at a hearing to review his case’s status scheduled for Sept. 19.

Erik Fortune, 60, of 6 Bates Road , Watertown, pleaded not guilty to assault and battery at his arraignment on Aug. 6. According to a police report, Fortune was arrested on these charges following an incident at Cube Smart at 96 Linden St. Fortune was released on the condition that he has no further charges filed against him.
