Judge amends drug trafficking charge for Waltham man

Waltham District Court Judge Sarah Kennedy accepted a partial nolle prosequi for Breyson Eduardo Barrera Pineda, 24, of 24 Lexington Terrace, Waltham, on Nov. 26.
The partial nolle prosequi, entered when a prosecutor reduces a criminal charge to a lesser offense, amended Pineda’s original charge of trafficking 200 grams or more of cocaine to possession with intent to distribute a class B drug.
Kennedy also lowered Pineda’s bail from $20,000 to $7,500.
Pineda’s terms of release ordered him to surrender his passport, which was disclosed at the Nov. 26 hearing as in custody of Massachusetts State Police.
The Commonwealth argued Pineda’s passport should remain in police custody as case evidence.
Kennedy updated Pineda’s terms of release to require that his passport remain in the custody of police and that Pineda report to probation until Dec. 5 or until he provides the court a signed and notarized affidavit acknowledging he will not apply for or obtain a new passport or passport card during his case.
According to Kennedy, Pineda has a U.S. Immigration and Customs Enforcement detainer that requires the Waltham District Court clerk’s office to notify ICE if Pineda surrenders his passport to their custody.
Pineda was arrested on Oct. 1 by Massachusetts State Police and arraigned at Waltham District Court on Oct. 2.
He is scheduled to appear at Waltham District Court for a pretrial hearing on Dec. 22.

Kennedy scheduled a Jan. 20 probable cause hearing for Schleiden Meneide, 37, of 265 Village Circle Way, Manchester, New Hampshire. Meneide was arrested by Waltham police on a warrant and charged with 20 firearms related counts following an incident on Jul. 28. He is currently being held on grounds of dangerousness at the Middlesex Jail in Billerica. Meneide is scheduled to appear at Waltham District Court on Jan. 20.
Kennedy rescheduled a Nov. 26 probable cause hearing for Tyler McDonald, 32, of 65 Lake St., Waltham. McDonald pleaded not guilty to electronic enticement of a child for human trafficking and trafficking of a person for sexual servitude at a Sept. 9 arraignment. Kennedy also scheduled a hearing to review status in relation to a resisting arrest charge, to which McDonald pleaded not guilty at an Aug. 11 arraignment. McDonald is currently held on $5,000 bail at Middlesex Jail in Billerica for the two trafficking charges. He is scheduled to appear for both hearings at Waltham District Court via Zoom on Dec. 10.
Kennedy scheduled a Dec. 23 probable cause hearing for William Macmillan, 55, homeless, of Waltham. Waltham police arrested Macmillan on Sept. 7 on a warrant for three counts of intimate assault and battery on a family or household member, three counts of assault and battery on a person disabled or over 60 and two counts of violating an abuse prevention order. Macmillan is currently being held at Middlesex Jail in Billerica on dangerousness. He is scheduled to appear at Waltham District Court on Dec. 23.
