Court Report: Judges dismiss, continue cases

Three felony cases were dismissed at Waltham District Court within the past week.

Estime Wesnoldjy, 27, of Waltham, had his case dismissed by Judge Amanda Ward on July 23 due to lack of prosecution. This means the Commonwealth was not prepared to prosecute the case and decided to dismiss it. Wesnoldjy was arraigned on a subsequent offense of assault and battery on a family or household member in February based on an alleged event that took place at a residence in Waltham.

Cole Stanley, 28, of Waltham, had his case dismissed for unknown reasons by Judge Ellen M. Caulo on July 28. Stanley was arraigned in January on charges of disorderly conduct and obstruction of justice stemming from an alleged event in the parking lot of Gordon’s Liquors on Main Street.

Jiemeng Chu, 36, of Waltham, had his case dismissed by Caulo for lack of prosecution on July 28. Chu was arraigned in April on a charge of assault and battery on a family or household member. The charge stemmed from an alleged incident at a residence in Waltham.

Additional court activity

Kleyvin Ruano Lopez, 21, of Waltham, was found responsible on June 8 for having an unregistered motor vehicle as part of a 24D plea deal. A 24D plea allows probation and a controlled substance education program in lieu of jail time for substance-related offenses. Ruano Lopez admitted responsibility for having an unregistered motor vehicle while four other charges were continued without a finding. 

When charges are continued without a finding, this means the Commonwealth does not have enough evidence to convict the accused of the charges and will dismiss the charges at the end of a determined probationary period if all terms of probation are followed. The charges were in relation to an alleged incident that took place in the McDevitt Middle School parking lot in March of this year. On July 29, Caulo decided that the case would be continued without a finding until June 8, 2027.

No new documents pertaining to cases in Waltham were available this week from the clerk’s office at Waltham District Court.
