Waltham man indicted on charges in connection with fatal altercation

A Waltham man involved in a fatal road rage incident in May was arraigned Friday in Middlesex Superior Court following an indictment from a Middlesex Grand Jury. 

The charges are based on an incident that took place on May 27 at Woodside’s Gas Station in Waltham in which Timothy Scalisi, 31, of Waltham, allegedly picked up Nicholas Dagostino, 27, of Waltham, and brought him violently to the ground. While Dagostino was able to speak to police on-scene, he later became confused and nauseous. He was brought to Lahey Burlington Medical Center where he ultimately died of his injuries on May 29.

According to a press release by the Middlesex District Attorney’s Office, Scalisi was indicted by a grand jury on one count of manslaughter in Middlesex Superior Court. He is being held on $10,000 bail. His Waltham District Court charges of manslaughter and assault and battery with serious bodily injury were dismissed on Sept. 10 by Judge Amanda Kennedy. No other details about the dismissal were immediately available via MassCourts.

Scalisi was ordered to stay away from and have no contact with the victim’s family or witnesses in the case. Additionally, Scalisi was made to surrender his passport and must stay in Massachusetts. His next court date in Middlesex Superior Court is set for Nov. 10.
