Lynn man arrested for allegedly driving under the influence on suspended license

A man from Lynn was arrested in Waltham this week for allegedly driving under the influence of alcohol on a suspended license.
On Sept. 25 at 5:28 p.m., an officer pulled over a vehicle turning from Moody Street onto Carter Street that was being driven erratically. According to the police report, a mint nips bottle was visible between the passenger seat and the middle console of the car. The driver, identified as Hector A. Perez Lopez, 32, of Lynn, allegedly smelled of mint liqueur. After running the driver’s name through the CJIS system, it was discovered he had three active arrest warrants.
According to the police report, Perez Lopez was asked to step out of the car but was unable to stand up by himself and had bloodshot eyes and slurred speech. He was unwilling to do standardized field sobriety tests.
Perez Lopez was taken into custody and charged with operating under the influence of liquor, operating a motor vehicle with a suspended license subsequent offense, operating under the influence while having a license suspended for an OUI and negligent operation of a motor vehicle. He pleaded not guilty on Sept. 28 to all charges. Judge Ellen M. Caulo released him on personal recognizance. Perez Lopez will face a pretrial hearing on Nov. 16.
Additional court activity
Henry Aguilar, 51, of Waltham, pleaded not guilty on Sept. 23 to three counts of assault and battery on a family or household member. The charges relate to an alleged incident at a Waltham residence. He was released on personal recognizance by Judge Raquel J. Webster and will face a pretrial hearing on Nov. 3.
Steven J. Dinauta, 30, of Waltham, pleaded not guilty on Sept. 29 to one count of violating a harassment prevention order. Caulo released him on personal recognizance and he will face a pretrial hearing on Oct. 29.
Michael A. Guinta, 66, of Waltham, had charges against him dismissed on Sept. 23. He had faced one count of assault and battery on a household or family member and one count of assault and battery on a disabled or elderly person. The charges, which were in relation to an alleged incident in May, were dismissed due to lack of prosecution, meaning that the Commonwealth was not equipped to prosecute the case and decided to dismiss it.
Bianca Lavargna, 33, had two cases against her dismissed on Sept. 23. The first case stemmed from an alleged incident in April and consisted of one count of possession of a class A drug and one count of possession of a class B drug. This case was dismissed by request of the Commonwealth. An additional case from an alleged incident in March consisted of one count of possession of a class A drug. That charge was dismissed through a nolle prosequi motion, meaning the state decided not to pursue it. A nolle prosequi motion allows the state to refile the charges within the statute of limitations of the crime.
Irma G. Osores, 37, of Waltham, had charges against her dismissed on Sept. 29. The charge of one count of assault on a person over 60 or a disabled person was related to an alleged incident in June. The charge was dismissed due to lack of prosecution.
