Court Report: Multiple Waltham residents granted Lavallee hearings

The Waltham District Court granted three residents Lavallee hearings this past week as a result of the recent statewide public defender strike. Under the Lavallee protocol, the court must dismiss the defendants’ cases if it cannot provide them with legal representation within 45 days of their arraignments.

Jonathan Flores-Duran, 20, of 205 Adams St., Waltham, pleaded not guilty to operating a motor vehicle while under the influence of alcohol, leaving the scene of property damage and a marked lane violation at his Aug. 11 arraignment. Flores-Duran was arrested on these charges by Waltham police officers on Aug. 10. The court released him on the condition that he appear for his Sept. 25 Lavallee hearing. 

Tyler McDonald, 32, of 65 Lake St., Waltham, pleaded not guilty to resisting arrest at his arraignment on Aug. 11. McDonald was arrested on this charge, as well as a warrant for a larceny by Waltham police officers on Aug. 9. The court released him on the condition that he appear for his Lavallee hearing on Sept. 25.

Jorge Caceres, 52, homeless, of Waltham, pleaded not guilty to felony breaking and entering and larceny from a building at his arraignment on Aug. 12. Caceres was arrested on the charges by Waltham police officers on Aug. 11. The court released Caceres on the condition that he appear for his Sept. 29 Lavallee hearing.
